Welcome to DigitalMaker.ai. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and platform (collectively, the "Service"). By accessing or using DigitalMaker.ai, you agree to be bound by these Terms.

1. About Us

Digital Maker AI is a trading name of Digital Income FZE, a company registered in the Sharjah Publishing City Free Zone, United Arab Emirates.

DigitalMaker.ai provides AI-powered tools for creating digital products and faceless video content. Our Service enables users to generate text, images, documents and video using artificial intelligence technology.

2. Acceptance of Terms

By creating an account, accessing, or using our Service, you confirm that:

  • You are at least 13 years of age
  • You have read, understood, and agree to these Terms
  • You will comply with all applicable laws and regulations

    • If you do not agree to these Terms, you must not use our Service.

    3. Account Registration and Requirements

    3.1 Account Required

    An account is required to use DigitalMaker.ai. You must provide accurate, current, and complete information during registration.

    3.2 Newsletter Subscription

    By creating an account, you agree to receive the Digital Maker AI newsletter, which may include:

  • Product updates and new features
  • Tips and best practices for using our Service
  • Special offers and announcements
  • Educational content related to digital product creation

    • You may unsubscribe from the newsletter at any time by:

  • Clicking the "unsubscribe" link in any email we send
  • Contacting support@digitalmaker.ai
  • Updating your email preferences in your account settings

    • Note: Unsubscribing from marketing emails will not affect transactional emails (password resets, account notifications, billing confirmations) which are necessary for the operation of your account.

    3.3 Account Security

    You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

    • 3.4 Account Deletion

    You may close your account at any time from Settings > Plan > Close my account. Closing your account immediately cancels any active subscription, and no refund is given for the remaining part of a monthly or annual billing period. You will be signed out and unable to log in. Your account and associated data will be permanently deleted within 30 days, in accordance with our Privacy Policy. During those 30 days you may ask support@digitalmaker.ai to restore the account; a cancelled subscription is not restored and must be restarted.

    4. Service and Pricing

    4.1 Plans and Pricing

    DigitalMaker.ai operates a free tier alongside paid subscription plans. Current plan names, features, usage allowances and prices are displayed on our Pricing page, which forms part of these Terms. Paid plans are available on monthly and annual billing cycles.

    We may change our pricing, plan structure or usage allowances from time to time. Where a change affects an existing subscription, we will give you advance notice, and the change will take effect from your next billing cycle. Continuing to use a paid plan after a price change takes effect constitutes acceptance of the new price.

    4.2 Billing and Usage

  • You will only be charged after explicitly subscribing to a paid plan
  • Subscriptions renew automatically at the end of each billing cycle until cancelled
  • All payments are processed securely through third-party payment processors
  • Paid plans include monthly usage allowances, which may include video generation minutes. Allowances reset at the start of each billing cycle and do not carry over
  • You may cancel at any time. Cancellation prevents future billing, and your access continues until the end of the period you have already paid for

    • 4.3 Refunds

    Refunds are governed by our Refund Policy, which sets out the applicable refund windows, the account usage limits that must not be exceeded to qualify for a full refund, and the processing fee deducted from approved refunds. In summary, monthly plans may be refunded within 3 days and annual plans within 7 days of your initial subscription payment, subject to those conditions.

    In the event of any inconsistency between these Terms and the Refund Policy in relation to refunds, the Refund Policy prevails. Nothing in these Terms or the Refund Policy affects any statutory rights you may have as a consumer under the laws of your country of residence.

    4.4 Service Availability

    We strive to maintain Service availability but do not guarantee uninterrupted access. Scheduled maintenance may occur, and we will make reasonable efforts to notify users in advance.

    5. User Content and Intellectual Property

    5.1 User-Generated Content

  • Users generate content using our AI tools, including text, images, documents and video
  • You own all content you create using DigitalMaker.ai
  • You may share, distribute, monetise, or resell content you create with our Service
  • You do not upload content to our platform; all content is generated through our AI tools

    • 5.2 Our Intellectual Property

  • All prompts, templates, algorithms, and proprietary tools provided by DigitalMaker.ai remain our intellectual property
  • You may not copy, reproduce, or create derivative works based on our proprietary prompts and systems
  • The DigitalMaker.ai brand, logo, and design elements are protected by intellectual property laws

    • 5.3 License to Use Service

    We grant you a limited, non-exclusive, non-transferable license to use our Service for its intended purpose in accordance with these Terms.

    6. Prohibited Uses

    You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Engage in spamming, phishing, or sending unsolicited communications
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Reverse engineer, decompile, or disassemble any part of our Service
  • Use automated tools (bots, scrapers) to access the Service without permission
  • Create multiple accounts to abuse free tier limitations
  • Resell or redistribute our proprietary prompts or systems
  • Violate any applicable laws or regulations

    • 7. AI-Generated Content Disclaimer

    7.1 No Guarantees

    Content generated using our AI tools is provided "as is." We do not guarantee:

  • Accuracy, completeness, or reliability of AI-generated content
  • That AI outputs will be error-free or suitable for your specific purpose
  • Any particular results or outcomes from using our Service

    • 7.2 User Responsibility

    You are solely responsible for:

  • Reviewing and verifying all AI-generated content before use
  • Ensuring content complies with applicable laws and regulations
  • Any consequences arising from your use of AI-generated content

    • 7.3 Not Professional Advice

    DigitalMaker.ai does not provide:

  • Financial, legal, medical, or professional advice
  • Guarantees of earnings, income, or business success
  • Any warranties regarding the commercial viability of generated content

    • Always consult qualified professionals for financial, legal, or medical matters.

    8. Data Collection and Privacy

    8.1 Information We Collect

    We collect:

  • Email addresses for account creation and communication
  • Usage data and analytics to improve our Service
  • Payment information for subscription users (processed by third-party payment processors)

    • 8.2 Third-Party Services

    We use third-party services to operate our platform, including AI providers (OpenAI, Google Gemini, Anthropic Claude) for content generation. These providers have their own privacy policies.

    8.3 Cookies and Analytics

    We use cookies and analytics tools to improve user experience and Service performance. By using our Service, you consent to our use of cookies.

    8.4 Data Sharing

    We do not sell or share your personal data with third parties for marketing purposes. Data is only shared with service providers necessary to operate our platform.

    9. Limitation of Liability

    9.1 No Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

    9.2 Limitation of Damages

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL INCOME FZE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Issues with AI-generated content or its accuracy

    • 9.3 Maximum Liability

    Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

    10. Indemnification

    You agree to indemnify, defend, and hold harmless Digital Income FZE (trading as Digital Maker AI), its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you generate and use from our Service

    • 11. Account Termination

    11.1 Termination by You

    You may terminate your account at any time by contacting support@digitalmaker.ai.

    11.2 Termination by Us

    We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Use the Service for illegal purposes
  • Create risk or legal liability for Digital Maker AI

    • 11.3 Effect of Termination

    Upon termination:

  • Your access to the Service will cease immediately
  • You remain liable for any outstanding payments
  • Sections of these Terms that should survive (liability, indemnification, governing law) remain in effect

    • 12. Modifications to Service and Terms

    12.1 Service Changes

    We reserve the right to:

  • Modify, suspend, or discontinue any feature of the Service
  • Change pricing structures and plan features
  • Update our technology and AI providers

    12.2 Changes to Terms

    We may update these Terms from time to time. We will provide at least 7 days' notice before changes take effect by:

  • Posting updated Terms on our website
  • Sending email notification to registered users
  • Displaying in-app notifications

    • Continued use of the Service after changes constitutes acceptance of the updated Terms.

    13. Governing Law and Dispute Resolution

    13.1 Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles.

    13.2 Dispute Resolution

    Any disputes arising from these Terms or your use of the Service shall be resolved through:

  • Good faith negotiations between the parties
  • If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates

    14.1 Entire Agreement

    These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Digital Maker AI.

    14.2 Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

    14.3 Waiver

    Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

    14.4 Assignment

    You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

    14.5 Force Majeure

    We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, or internet/hosting failures.
